The insured (Property Owner) has certain responsibilities when a covered peril (loss/event i.e. wind, hail, water, etc.) occurs:
It’s CRITICALLY IMPORTANT that when filing a claim everything is done properly or an insurer can and may deny a claim that is certainly valid.
- An insured MUST take immediate action to prevent any further loss (i.e. tarps to prevent further water intrusion).
- An insured must identify if a named peril (covered cause of loss) has caused direct physical loss.
- An insured must identify “when” a named peril has caused direct physical loss to the insured property.
- An insured must determine if premiums were current at the time of the direct physical loss
- Obtain a “Reasonable Methods of Repair” from a well-established and licensed General Contractor that specializes in Insurance Restoration Contracting.
- Provide the cost of repairs to restore the insured property to its pre-loss condition and establish the “Reserve”.
- This is a very important step in the Claims Process.
- The “Reserve” (amount of $ set aside for the restoration/repairs) is established when an insured has met ALL the conditions above.
- For example, in Colorado subsection (8) of Colorado Revised Statute 10-4-110.8 states the insurer must consider an estimate from a licensed contractor “submitted by the policyholder” as a bases for establishing the replacement cost:
- (8) The insurer must consider, subject to the insurer’s underwriting requirements, an estimate from a licensed contractor or licensed architect submitted by the policyholder as the basis for establishing the replacement cost of a dwelling.
- IF an insured files a claim with their insurer and has not provided an estimate/contract for the repairs, then the insurer will write an estimate for the absolute minimum to indemnify (compensate for a loss) the insured.
- Once this is done, the insured will find themselves in an uphill battle for a fair and equitable settlement with a reputable, licensed, insured, and high-quality contractor to provide their services.
